Terms of Service
Welcome to AICalling.app ("AICalling", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of our white-labeled AI Voice Calling SaaS platform.
By creating a Tenant account, connecting Stripe API credentials, purchasing a subscription plan, or dialing phone numbers through our platform, you agree to be fully bound by these Terms. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity.
1. White-Label Platform License
Subject to continuous compliance with subscription payments, AICalling grants you a limited, non-exclusive, non-transferable, revocable license to host our dashboard client interface under your own custom branding configurations and domains. You are allowed to:
- Market and sell AI voice agent subscriptions to your own custom clients at pricing metrics you construct.
- Maintain absolute splits on client margin marks using your linked reseller Stripe account.
- Enable multi-tenant permission controls for administrators, managers, and agents in your organization.
You may not decompile, reverse-engineer, translate, or attempt to extract the core voice-routing gateway logic, ElevenLabs synchronization clients, or telephony middleware frameworks.
2. Subscription Billing & Metered Usage
We charge Tenants a platform-level subscription fee plus metered usage based on call minutes routed through our voice-routing engine.
- Platform Fees: Billed on a recurring monthly basis as designated in your plan tier. Platform subscriptions are processed securely via our primary Stripe checkout channels.
- Metered Minutes: Usage is reported dynamically to Stripe using usage records. You are billed automatically for voice minutes consumed by your agents.
- Client Pricing Plans: You are solely responsible for managing the billing profiles, invoices, and payment success rates of your end-clients. AICalling is not responsible for refund disputes raised by your customers.
3. Telephony & Acceptable Use Regulations
By leveraging Twilio, Plivo, or SIP trunk connections mapped to our AI agent pipelines, you agree to strictly comply with international telecommunication standards:
- You must not execute outbound campaign dialing containing unsolicited spam or fraudulent phishing calls.
- You agree to comply with the US Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the EU ePrivacy Directive, and all local laws governing automatic voice dialers.
- You must secure explicit opt-in permissions from call contacts before initiating outbound campaign runs.
- All AI voice agent call prompts must clearly disclose to recipients that they are conversing with an AI virtual assistant at the initiation of the call sequence.
4. ElevenLabs Vocals & Voice Clones
Our service interfaces with the ElevenLabs Conversational AI platform. When cloning voices or choosing speech templates:
You warrant that you possess all necessary copyright clearances, licenses, and explicit approvals to use any cloned voice profile. You agree to hold AICalling fully harmless from any intellectual property disputes, claims of deepfake vocal impersonations, or celebrity voice abuse stemming from configurations you publish.
5. Limitation of Liability
AICalling.app provides the platform on an "as is" and "as available" basis. We do not warrant that speech routing networks will remain completely uninterrupted, low-latency, or error-free at all times due to downstream API carrier updates.
In no event shall AICalling be liable for any indirect, incidental, special, exemplary, or consequential damages, including loss of client revenues, platform subscription splits, or database record exposures, arising out of your operation of white-labeled networks.
6. Termination
We reserve the right to suspend or terminate your Tenant organization access immediately, without prior notice, if you breach these Terms, route illegal robocalls, fail subscription billing checkpoints, or engage in activity that degrades our ElevenLabs or telephony connections.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Delaware, United States, without regard to conflict of law principles. Any legal action arising from these Terms must be filed in courts located in Delaware.
8. Updates to Terms
We may revise these Terms from time to time. The most current version will always be posted on this page. By continuing to operate your branded Tenant nodes after updates become active, you agree to be bound by the revised Terms.
